TikTok Talent Takes Legal Turn: Dancer Sues Roblox Over Copyright

Popular TikToker Kelly Hayer has filed a lawsuit against the gaming platform Roblox, alleging copyright infringement of her dance choreography. The news was reported by Reuters.

In June 2024, Hayer posted a self-choreographed dance to Charli XCX’s hit song “Apple,” which quickly went viral. The performance gained significant attention, even prompting Charli XCX herself to incorporate the dance into her live shows and invite Hayer to perform with her in New York.

While Fortnite reportedly obtained permission to use the dance, Hayer claims that Roblox failed to do the same. Her attorney, Miki Anzai, stated, “Roblox used Kelly’s creative work without any agreement. We were left with no choice but to file a lawsuit to ensure fair compensation.”

According to Polygon, Roblox earned over $123,000 from selling an emote based on the choreography. In response, Roblox issued a statement saying it is committed to protecting the intellectual property rights of creators.
