Apple, Samsung and Google Face US Patent Investigation Over 3D Audio

Apple, Samsung, and Google—three of the world’s leading technology companies—are facing major legal complications in the United States over allegations of patent infringement involving spatial or 3D audio processing technology.

The US International Trade Commission (USITC) has formally launched an investigation following a complaint filed by California-based small audio technology company “BoomCloud 360.” If the allegations are proven in the commission’s proceedings, the companies could face restrictions on the import and sale of certain smartphones and audio devices in the US market.

Patent Dispute and BoomCloud 360’s Claims

In August this year, BoomCloud 360 filed a complaint with the USITC alleging infringement of three specific patents. The California-based startup primarily develops software for cloud-based sound optimization and three-dimensional audio experiences.

The company claims that the accused firms are using its patented audio processing technology in their devices without authorization. In its legal filing, BoomCloud 360 has sought a “Limited Exclusion Order” and an injunction. If granted, the orders could halt the commercial supply of devices that use the disputed technology.

However, the specific devices targeted by the complaint have not yet been officially disclosed.

Tech Giants’ Countermoves and What Lies Ahead

The three tech giants have already intensified their legal efforts to avoid the risk of major product restrictions. Apple, Samsung, and Google have filed petitions in court seeking a “declaratory judgment” against BoomCloud 360’s claims, asking the court to establish that the technologies they developed are legally valid.

The outcome of the USITC’s high-profile investigation and subsequent court proceedings will determine whether the popular technology products involved can continue to be sold in the United States or whether the dispute will be resolved through a legal settlement.
