Bangladesh Association of Software and Information Services (BASIS), a leading trade organization in the IT sector, has had its election schedule canceled. As a result, the election of the organization (2021-23) is not being held as it was scheduled.
The information was conveyed in a letter to the director of the commerce ministry. A copy of the letter has reached Digibangla.
The letter, signed by SM Kamal, Chairman, BASIS Selection Board, said, He sent a proposal to the DTO on May 20, 2019, to amend the relevant sections of the constitution. Following the hearing on 12 February 2019, the DTO approved the proposal on 18 February 2019, to amend the constitution of BASIS. It was then submitted to the DTO on March 8, 2019, by RJSC after incorporation.
Chaldal.com, a member of BASIS, filed a writ petition (No. 2639/2019) in the High Court on March 11, 2019, seeking annulment of the said amendment. In view of this, on March 20, 2019, the High Court Division issued a six-month ban on the amendment.’
The letter further said, “In the meantime, in view of the Memorandum of Understanding executed by Chaldal.com with BASIS, the Hon’ble Court on March 2, 2021, has lifted the prohibition on the writ petition subject to the implementation of the terms of the Memorandum of Understanding.”
According to the agreement executed with Chaldal.com, further amendment of the existing rules of association is required in the interest of granting voting rights to the members of all categories proposed by BASIS and defining the membership of the international category.
In order to implement the judgment of the case, the following steps need to be taken to change the constitution of BASIS:
1) Notice of Special General Meeting (EGM) issued with a proposal to amend the rules of the association.
2) Finalization of the EGM program and revision proposal.
3) Submitted to the DTO for approval of the amended Union Code DTO.
4) Incorporation of RTO in RJSC as approved by DTO.
In this situation, it is not possible to conduct the election till the finalization of the rules of the association. If the constitution is finalized after the amendment, the election will be conducted accordingly.
Note that the organization’s (2021-23) term election was scheduled on May 22.
