The High Court has summoned all kinds of documents from e-commerce company Evaly, which has been accused of cheating with customers. The Registrar of Joint Stock Companies and Firms has been directed to submit these documents to the court by October 12. Lawyer Syed Mahsib Hossain confirmed the order.
A single bench of the High Court Justice Muhammad Khurshid Alam Sarkar passed the order on Thursday (September 30th).
Lawyer Syed Mahsib Hossain said the High Court had banned the sale and transfer of all types of Evaly assets on Wednesday (September 22nd) following an earlier hearing by a customer.
A customer lodged complaints repeatedly to the Governor of Bangladesh Bank, e-Cab, Consumer Rights for not getting his product even after five months of ordering the product in Evaly. As there was no remedy, an application was lodged to the High Court seeking termination of Evaly. Following the hearing of the application, the court banned the sale and transfer of all assets of Evaly. At the same time, the court issued a notice asking why Evaly would not be terminated. After that application, another application was made for liquidation of the company. The court passed the order today after hearing the appeal.
Lawyer Syed Mahsib further said that the applicant ordered a washing machine at Evaly Online Shopping Mall last May. At the time of ordering, he paid through mobile phone-based digital financial services. The company then bought him a product online and gave him a receipt for Taka 33,308. But so far, they have not handed over the product. When the applicant contacted to get the product, he was repeatedly assured, but neither did they hand over the product nor they refunded the money. Later, the aggrieved customer repeatedly complained to the Governor of Bangladesh Bank, e-Cab, consumer rights in this regard, but he did not get any remedy; he approached the High Court and appealed to the High Court to terminate the company.
